Thank you for using our Application Programming Interfaces and the other materials provided at sourcemap.com/info/api-docs (collectively, the “API” or “APIs”). If you have questions, please contact us.
This is the API License Agreement (“API Agreement”) between the Licensee (“you” or “your”) and Sourcemap (“we,” “us,” or “our”).
b. You shall:
ii. Maintain an active email address in your profile and respond to our emails if we try to reach you.
iii. Comply with any license terms, requirements, or restrictions imposed on usage of the data available on our web site by their respective licensors. Please remember that we don’t own the data – our users do. Although you can use our APIs to access the data we host, neither our provision of the APIs nor your use of the APIs overrides the data owners’ license terms, requirements, or restrictions. These may include, but are not limited to, any relevant provisions regarding attribution, “all rights reserved” notices, Creative Commons licenses, or other terms and conditions that may be agreed upon between you and the owners. You are solely responsible for complying with the data owners’ license terms, requirements, and restrictions.
iv. Upon request of a registered user (“Member”), remove from your application data or other information owned by that Member within 24 hours.
v. Be at least 18 years of age.
c. You shall not:
i. Use an unreasonable amount of bandwidth. We are a small organization, so please take it easy on our servers. Specifically, you agree not to use the APIs in any manner or degree that adversely impacts the performance, stability, function, responsiveness, usability, or hosting of our web site or its servers, or which adversely impacts other users or applications using the APIs.
ii. Use our APIs to implement, support, enable, or interact or exchange data with any application that replicates or attempts to replicate our essential user experience.
iii. Use our APIs to copy, archive, or duplicate (collectively, “scrape”) any substantial portion of our content.
iv. Attempt to cloak or conceal your identity or your application's identity when requesting authorization to use our APIs.
v. Defeat or attempt to defeat our API key authentication system, usage tracking system, or any other measures adopted for authentication, security, tracking, or billing purposes.
vi. Use our APIs to distribute, transmit, implement, support, enable, or interact or exchange data with any application that constitutes, promotes, or is used in connection with spyware, adware, malware, or any malicious programs or code.
vii. Use our APIs in any manner or for any purpose that violates any law or regulation, or any right of any person, including but not limited to intellectual property rights, rights of privacy, or rights of personality.
viii. Sell, lease, or sublicense our APIs or access thereto, or derive revenues from the use or provision of our APIs, whether for direct commercial or monetary gain or otherwise.
We reserve the right, in our sole discretion, to set usage guidelines and quotas; to modify, limit, or discontinue the availability of specific APIs or the API generally; or to charge fees for the use of those APIs that add or modify information. You agree not to circumvent or attempt to circumvent such restrictions.
Either party may terminate this API Agreement at any time, for any reason or for no reason including, but not limited to, if you violate any provision of this API Agreement. In the event of termination by either party, you shall immediately cease using the API. We reserve the right to disable API accounts or authentication keys at any time and for any reason.
You are responsible for complying with all applicable laws, rules and regulations, all third-party rights, and our policies.
Except as expressly granted herein, neither party through this API Agreement grants the other party any intellectual property rights or other proprietary rights.
You may be given access to our confidential and proprietary non-public information, specifications, or software (“Confidential Information”). You may not disclose any Confidential Information to any third party without our written consent. You agree to protect such Confidential Information from unauthorized use, access, or disclosure in the same manner that you would use to protect your own proprietary information of a similar nature, and in any event with no less than a reasonable degree of care.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT OUR WEB SITE, ITS HOSTED DATA, AND THE API ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. YOUR USE OF THE API IS AT YOUR SOLE RISK. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE API’S OPERATION OR THE INFORMATION, CONTENT, OR MATERIALS AVAILABLE THROUGH THE API. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE. WITHOUT LIMITATION, WE DISCLAIM ANY AND ALL WARRANTIES REGARDING THE SECURITY, RELIABILITY, ACCURACY, TIMELINESS, AND PERFORMANCE OF THE API, ITS SERVICES, AND ITS FUNCTIONS, AS WELL AS ANY OF CONTENT AND INFORMATION ACCESSED THROUGH THE API.
WE SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY USE YOU MAKE OF THE APIS. YOU SHALL INDEMNIFY AND HOLD US HARMLESS FROM ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS AND FEES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM YOUR USE OF THE APIS, USE OF YOUR RESULTANT APPLICATIONS, OR FOR ANY BREACH OF THIS API AGREEMENT AND/OR ANY OF THE REPRESENTATIONS AND WARRANTIES MADE HEREIN.
WE ARE NOT LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APIS, REGARDLESS WHETHER BASED UPON BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, PRODUCT LIABILITY, OR ANY OTHER TORT OR FINANCIAL LOSS, AND REGARDLESS WHETHER WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES.
This API Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to the rules of conflict of law that may cause the laws of another jurisdiction to apply. Users agree to the sole and exclusive jurisdiction and venue of the federal or state courts serving Middlesex County in the Commonwealth of Massachusetts in the event of a dispute of any kind arising from or relating to this agreement. These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
If any portion of this API Agreement shall be found by a court to be invalid, all other provisions of the API Agreement shall remain in full force and effect; and both parties agree and request that the court should give effect to the expressed intention of the parties as reflected in the API Agreement, including to the degree possible the invalidated provision(s).
We reserve the right to change the terms of this API Agreement or the Terms of Service at any time, at our sole discretion. You are responsible for regularly reviewing the API Agreement and Terms of Service. Your continued use of the API constitutes your agreement to all such changes.
